Participation Agreement

(includes risk assumption, liability waiver, and indemnification clauses)

Please read this document carefully. It must be signed by every adult (eighteen years and older) participating in the recreational and other activities provided by the climbing center referred to below (the climbing center). If the participant is a minor, at least one parent or legal guardian (both referred to herein as parent) must sign to demonstrate agreement with the terms and conditions of this Participation Agreement (the Agreement) on behalf of themselves and the minor participant. The term participants as used in this Agreement, includes individuals taking part in activities, non-staff individuals observing or assisting with activities, and anyone present at the climbing center or other activity locations whose agreement to these terms is required by the Administration of the climbing center.


As a condition of participation in the recreational activities and actions provided by the climbing center, the undersigned adult participant, or the parent of a minor participant (acting on their own behalf or on behalf of the minor participant), acknowledges and agrees to the following:
This Agreement applies to activities provided by any legal entities owning or managing climbing centers and activities under the name Mono at any of their locations, including but not limited to outdoor climbing locations on public lands.

 

Activities and Risks

The recreational and other activities provided by the climbing center include, but are not limited to:
mountain climbing, indoor climbing, and remote outdoor locations climbing, top rope climbing, lead climbing, auto-belay climbing, and speed climbing, traveling to remote climbing locations, and walking (including crossing roads to the climbing center or secondary locations), rope climbing, using training and climbing equipment, weight training, climbing lessons, yoga and exercise classes, all group activities of the climbing center, catering services, simple tours of the climbing
center and remote climbing locations, and any other related activities.

Participants assume individual responsibility for managing the risks of activities, supervised or not, which includes deciding not to participate in activities that they feel are beyond their abilities or involve harmful conditions. Participants must follow all policies, rules, and recommendations of the climbing center at all times. If I am a parent of a minor participant, I have explained these obligations to the minor or protected child.


Rock climbing and the climbing activities of the climbing center are inherently risky, and there is a potential for injury or loss of life even if all parties exercise due care and there is no equipment failure or misuse. Specifically, the risks involved in the climbing center's activities include: (1) misuse of climbing walls, equipment, or facilities, (2) falls and potentially harmful contact with individuals, structures, and objects (fixed and movable), including climbing walls, climbing structures, holds, ropes, equipment (including equipment falling during route setting or otherwise), the floor, and other surfaces, (3) failure of facilities, climbing walls, holds, harnesses, auto-belays, and training and other equipment, (4) mental or physical health issues of participants and others, (5) transmission of infectious disease, whether related to the novel coronavirus SARS-CoV-2 (causing COVID-19) or other pandemics, epidemics, outbreaks, public health emergencies, or other related cases, (6) lack
of training and expertise, (7) negligence, errors, and misjudgment of participants and climbing center staff, including negligence in belaying, tying harnesses, using or tying into auto-belays, and any other failure to follow correct procedures, instructions, and operating policies, (8) injuries related to outdoor activities, including hiking on sometimes uneven terrain, falling trees and rocks, harmful plants and animals, and natural forces, (9) camping activities, including using cooking stoves and navigating the camping area, (10) accidents and illnesses, including allergic reactions, occurring in remote areas where emergency medical care may be significantly delayed, and (11) accidents during transportation to remote locations or walking to nearby climbing center locations.


The above list is indicative and does not include all the risks assumed by the Participant. However, it is worth noting two important points: The Participant is Fully Responsible for Their Training Although the climbing center provides guidance, the Participant is responsible for seeking and completing appropriate initial training courses before engaging in any such activity. The Participant also agrees to seek and complete any retraining or further training whenever deemed necessary. The Participant Understands That Soft Flooring Does Not Eliminate Risk The Participant agrees that the installed soft flooring in the bouldering area can only mitigate, not
eliminate, the risk of serious injury or loss of life from falling. These and other risks are an integral part of the climbing center's activities; without them, the activity would lose its value and appeal, and active participation would be discouraged. These and other risks may cause losses to Participants, including property damage, emotional distress, physical injury, permanent disability, paralysis, and even death.

 

Assumption of Risk
As an adult Participant or parent, I hereby acknowledge the risks described above and their inherent connection to the activities, as well as the possibility of other risks, known and unknown, inherent or otherwise. I expressly accept and assume all risks, known and unknown, inherent or otherwise, whether described above or not, involved in registering or participating in the climbing center’s recreational and other activities, using the equipment and facilities, or touring the climbing
center and remote locations, and traveling to and from activity locations. As a parent of a minor Participant, I have discussed the activities, responsibilities, and risks with the minor child who understands and accepts them, which I also accept, to the fullest extent permitted by law, on behalf of the aforementioned minor.
Liability Waiver and Indemnification The undersigned, as an adult Participant or parent (the parent agrees on their behalf and on behalf of the minor or protected child who is a Participant), to the fullest extent permitted by law, hereby releases and discharges any legal entity that owns or manages climbing centers and activities
under the name Mono, as well as the respective owners, directors, employees, agents, representatives, successors, and assigns (collectively referred to as the Released Parties) from any claim, liability, damage, and loss asserted by me or on behalf of the minor Participant, which arises or is related in any way to my or the minor’s registration or participation in any climbing center activity, use of equipment and facilities, or touring the climbing center and remote locations,
and traveling to and from activity locations. I understand that by signing this Agreement, I am waiving the right for myself and the child to assert a claim or initiate legal proceedings against a Released Party for bodily injury, property damage, death due to fault, product liability, or any other liability, to the fullest extent permitted by law.
I also agree to indemnify and hold harmless (i.e., defend and pay or reimburse) the climbing center and the other Released Parties for any claim and liability, loss, damage, or expense (including legal fees) arising from 1) a claim asserted by another Participant, rescuer, or any other person for loss or damage caused by my or the minor child’s act or omission, and 2) a claim asserted by any member of my or the minor child’s family, arising from my or the minor child’s registration or participation in any activity associated with the climbing center, use of equipment and facilities, or touring the climbing center and remote locations, and traveling to and from activity locations. These waiver and indemnity clauses include loss, damage, or expenses allegedly caused in whole or in part by the negligence of a Released Party, but not by gross negligence or willful misconduct.

 

Additional Provisions
As an adult Participant or parent, I acknowledge and agree to the following additional provisions: Medical: The climbing center does not have medical personnel or medical care for Participants or visitors. I hereby authorize and permit the climbing center to arrange emergency medical care for myself or, if the Participant is the minor or protected child, for that child. Neither I nor the said child suffer from any mental or physical illness that may pose a risk to ourselves or others. I, or the said child, have adequate health insurance to cover any medical expenses that may arise, and in any case, I assume responsibility for the related expenses. I agree, for myself and the said child, (i) to undergo any preliminary medical examinations required for access to the climbing center in the context of reopening after any closure due to an epidemic or pandemic or otherwise, (ii) to the collection and retention by the climbing center of any personal data reasonably required in the
context of such examinations, and (iii) to the disclosure by the climbing center of information to public health authorities (such as the Hellenic Center for Disease Control and Prevention or public
health departments) in connection with the detection and tracing of any communicable disease. Dispute Resolution: I agree, on behalf of myself and the minor child, to participate in good faith in efforts to resolve any dispute that may arise between myself or the minor child and a Released Party. If amicable resolution is not achieved, I agree that all disputes, conflicts, or claims between the parties will be submitted to binding arbitration under the then-applicable rules of the International Chamber of Commerce. I agree that the interpretation of this Agreement and any dispute between a Released Party and Participant or Parent will be subject to the substantive law of Greece (excluding conflict of laws rules). Any amicable resolution or arbitration proceedings will take place in Greece, in the region where the climbing center’s headquarters are located.
This Agreement applies to my and the minor child’s (as applicable) participation in the climbing center’s activities and will remain in effect until terminated in writing or expires in accordance with the provisions of Greek law. I have carefully read, understood, and knowingly signed this Agreement, and acknowledge that it is binding on me, the minor or protected child who is a Participant, and my or the said child’s family, heirs, executors, administrators, and representatives. I agree that the terms of this Agreement have the maximum possible breadth permitted by applicable law and that, if any provision of this Agreement is found invalid by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.
